Director Terms
These terms apply to every director account on Filmling and to every film, series and episode a director publishes through it. Directors accept them when their account is created, and affirm the rights warranty in section 2 each time they submit a title for approval. Filmling records the date and version of each acceptance.
1 · WHAT FILMLING IS
Filmling is a distribution platform operated by Filmling Studios for independent filmmakers. Everything shown on filmling.com and in the Filmling apps for Apple TV, iPhone and iPad is uploaded by the director who made it, through their own account, and is reviewed by Filmling staff before it is published. Filmling does not index, link to, or stream content from any third-party streaming service or catalogue.
2 · RIGHTS WARRANTY
By submitting a film, series or episode you represent and warrant to Filmling that:
- you own, or hold a valid licence covering distribution on Filmling for, every element of the content — including the footage, performances, screenplay, music, sound, artwork, titles, trademarks and any third-party material it contains;
- you have obtained all releases and consents needed from the people who appear in it and the people who worked on it;
- publishing the content on Filmling and in the Filmling apps infringes no copyright, trademark, right of publicity, privacy right or other right of any person or organisation, and breaks no law;
- the content is your own production and is not a copy, re-upload or re-edit of a work distributed by anyone else without that distributor's written permission; and
- you will keep records that evidence the rights above and will provide them to Filmling within five business days if asked.
3 · LICENCE TO FILMLING
You keep ownership of your work. You grant Filmling Studios a non-exclusive, worldwide licence to host, encode, stream, display, promote and distribute the content, its artwork and its metadata on filmling.com, in the Filmling apps and in Filmling's marketing of your title, for as long as the content is published on the platform. You can take a title offline from your director console at any time, after which the licence continues only as far as needed to honour tickets and replay windows already sold.
4 · REVIEW, TAKEDOWN AND CLAIMS
Filmling staff review every submission before it goes live and may decline, send back or remove any content at their discretion, including on receipt of a credible rights complaint. Rights holders can report content by emailing [email protected]; Filmling takes reported content offline while the claim is investigated. You are responsible for any claim, loss or liability that arises from a breach of the warranty in section 2, including any claim brought against Filmling or against the app stores that distribute the Filmling apps, and you will indemnify Filmling Studios for it. Repeated or deliberate breaches end the account.
5 · ACCOUNTS, FEES AND PAYOUTS
Accounts are personal to the director or production company that opens them. Premieres carry the processing fee and ticket revenue share shown in the director console at the time of submission; payouts are made through Stripe Connect to the account holder. Filmling may suspend an account that breaches these terms.
6 · CHANGES
Filmling may update these terms. The version in force is shown at the top of this page; a new version is presented for acceptance the next time you submit a title. Questions go to [email protected].
